The Prestige Process
The settlement process in Western Australia may be standard, but that doesn’t mean our service is.
At Prestige Settlements, our team of specialised settlement agents focus on the individual requirements of your journey. Whether you’re buying or selling, there are several moving parts to the settlement process that need to be co-ordinated for a successful outcome.
The Prestige Process is built on clear communication, frequent updates, and meticulous attention to detail, delivering a service you can trust. While every settlement journey is different, this is an overview of what you can expect during your settlement.
OFFER ACCEPTED
- Buyer and seller agree on price and conditions.
- Contract of Sale is signed by both parties.
- Buyer pays the deposit to the selling agent.
APPOINT YOUR SETTLEMENT AGENT / CONVEYANCER
- Buyer (and seller) each appoint a licensed settlement agent or conveyancer.
- Authority to Act form is completed.
- Conveyancer begins reviewing the contract and title documents.
- The contract of sale is lodged with the Office of State Revenue by the due date to avoid penalties.
SPECIAL CONDITIONS
- Settlement agent checks the Certificate of Title, encumbrances, caveats, rates and land tax.
Ensures there are no issues affecting ownership transfer. - Any special conditions (eg. Building inspection, pest inspections) are satisfied and dates met.
- We wait for finance to be approved within the contractual date.
PROCEEDING TO SETTLEMENT – TITLE SEARCHES AND PROPERTY CHECKS
- Any special conditions (e.g. building inspection, pest inspection) are satisfied or negotiated.
- We liaise with the banks involved with settlement.
- Seller & buyer should ensure all documents have been sent to their banks as per agents instructions.
- Sellers should complete their ATO Clearance certificate requests.
- Buyer and seller need to complete verification of identity. This is sent to you via text message from an outsourced provider. This is not a scam.
RATES, ADJUSTMENTS & UTILITIES
- Settlement agent prepares the Transfer of Land and related documents.
- Buyer and seller sign documents.
- Documents are verified and sent to the lender for stamping and readiness.
- It is the sellers responsibility to cancel utility services after final inspection has taken place.
- Sellers cancel any direct debits set up for the payment of water and shire rates.
FUNDS FOR SETTLEMENT
- Sellers will be contacted the day before settlement to verify bank details prior to settlement.
- Buyers need to check they have given their lender authority to draw down on a nominated bank account and ensure any funds being used to contribute towards settlement have been transferred to this account prior to settlement.
- PLEASE NOTE: Never transfer funds based on an email. Our office will never email trust details in the body of an email. Please always call the office to confirm trust details.
FINAL SETTLEMENT
- Settlement agent notifies the Water Corporation and local council of the change in ownership.
- Buyer and seller receive confirmation that settlement is complete.
- Title records are updated by Landgate.
- Settlement agents don't handle the hand over the keys. Please contact the real estate agent to organise key exchange.
